Iowa Late Rent Fee Laws: Limits, Grace Periods, and Penalties

How much can a landlord charge in Iowa?

Iowa Code § 562A.9(4) sets a two-tier statutory cap keyed to monthly rent. For rental agreements where rent does not exceed $700 per month, the agreement may not provide for a late fee exceeding $12 per day or a total of $60 per month. For rental agreements where rent is greater than $700 per month, the ceiling is $20 per day or a total of $100 per month. Both the daily rate and the monthly total are hard limits — you can charge the daily rate only until you hit the monthly cap. These are caps on what the rental agreement may provide, so a lease reciting a higher number is defective on its face regardless of whether the landlord ever collects it.

How late does rent have to be?

Iowa Code § 562A.9(3) makes rent payable without demand or notice at the time the parties agreed, and nothing in § 562A.9(4) requires a waiting period before the daily fee starts. If your lease grants a grace period, however, you must honor it.

Does the fee have to be in the lease?

Section 562A.9(4) is framed as a limit on what 'a rental agreement shall not provide,' so the fee must be in the written rental agreement to exist at all, and its stated amount must sit inside the applicable tier. An undisclosed late fee is not collectible.

What happens if you charge too much?

An over-cap late fee clause is a provision prohibited by Chapter 562A and is unenforceable under Iowa Code § 562A.11(2). If the landlord willfully uses a rental agreement containing provisions known to be prohibited, the tenant may recover actual damages plus not more than three months' periodic rent and reasonable attorney fees — a meaningful exposure for a boilerplate lease used across a portfolio.

Returned payment fees

Iowa Code § 554.3512 permits a surcharge of not more than $30 on a dishonored check, and only if the landlord clearly and conspicuously posted notice of the surcharge at the usual place of payment or stated it on the billing statement. Iowa Code § 554.3513 provides the civil remedy for collecting on the dishonored instrument.

Recent changes to the law

No enacted change. Senate File 2225, introduced February 5, 2026 in the 91st General Assembly, would have amended Iowa Code § 562A.9(4) along with other rental provisions, but it stalled in a Senate Judiciary subcommittee and did not become law. The two-tier caps remain in force.

What Iowa landlords get wrong

The tier is set by the rent in the agreement, not by the amount unpaid, so a $700 rent falls in the lower tier ('does not exceed seven hundred dollars') and $701 jumps you to the higher one. Watch this when you raise rent past $700 — the lease language should be updated, not just your ledger. A widely copied error online adds a third tier for rent of $1,400 or more at 2% of rent per day and 10% per month; that language comes from House File 866, a bill that was introduced but never enacted, and it is not Iowa law. Also remember the $30 NSF surcharge under § 554.3512 requires advance conspicuous notice, which most small landlords never post.

If you use one template across several units, that exposure multiplies.

Does Iowa give tenants a grace period before late fees?

Not by statute. Rent is payable without demand at the time the rental agreement specifies, and the daily late fee can begin the next day. If your lease grants a grace period, the landlord has to honor it. Iowa's three-day notice to pay or quit before an eviction is a separate procedural requirement, not a fee-free window.
